High Court has sought report from DGP in noise violation matter: Ferreira
Panaji: Aldona MLA Adv Carlos Alvares Ferreira on Wednesday said that the division bench of the High Court of Bombay at Goa has directed the Goa Director General of Police (DGP) to take action against violators of noise pollution rules.
Ferreira was representing the petitioner Arnold De Sa in the matter relating to rampant violations of the noise pollution rules and contravention of the Supreme Court order and various orders of the High Court.
Ferreira produced videos before the HC showing that music was being played outdoors beyond 10pm in the North Goa coastal belt.
While passing a detailed order, the division bench noted that “1. Prima facie, the material which is placed along with this Misc. Civil Application is quite disturbing. The material, at least, prima facie, indicates that the police authorities are bent upon not taking action against the violators of the noise pollution rules framed by the Government itself” and requested Ferreira to meet the DGP, with the police inspectors of Anjuna and Pernem Police Stations on Wednesday afternoon to apprise him of these violations and show him the videos, and directed DGP to ensure action is taken and to file a report.
The court also directed the DGP to ensure that the police inspectors should not wait for a written complaint to take action.
“Despite orders directing the DGP of the State to monitor the position, we think that at least prima facie, music continues to be played beyond the prescribed decibel levels beyond 10.00 pm in outdoor premises. In any case, the police seem to be most reluctant in taking up this issue seriously or controlling the noise pollution violations.,” the Court ruled.
Ferreira said that there should be hourly monitoring after 10pm by enforcement authorities to ensure playing of outdoor music is stopped beyond 10pm.
“There is definitely happening due to police patronage or due to patronage from some higher ups” he said.
