ADR can resolve lot of matter out of court: Ferreira
VAGATOR: Aldona MLA Adv Carlos Alvares Ferreira said that alternate dispute resolution (ADR) can be effectively used to resolve many matters out of court. He also said that ADR can boost investments in Goa and the country.
He was speaking at the Conference on Ease To Justice Through Arbitration and Mediation in Commercial Disputes organised by the Indian Council of Arbitration (ICA) at Vagator on Saturday.
“With ADR, you can settle many matters without having to go to court. You can do a pre-litigation mediation. In England, they have a system which makes it compulsory to undergo mediation, and in the event, you don’t settle it there and go up to the court fighting, the one who loses has to pay enormously,” he said.
“A lot of matters, including service matters, payment of wages, etc, get resolved out of court. And that is something that we need. I am a practicing lawyer, but it strikes my conscience that we charge people for matters that could get resolved very easily. That’s why, as much as possible, I try to resolve the issue without taking it to court,” he further said.
“Since there are a lot of investments coming into Goa, I think with ADR, there will be a free flow of investments in Goa, including India. People will be happy to come. No one likes litigation going on for 5 to 10 years and getting frustrated with the appeals, etc,” he added.
